Kirk McGill, a special counsel and First Amendment expert at law firm Hall Estill, said the company must obtain a stay to prevent the law from going into effect before the courts make a decision on their appeal.
"Therefore, I expect its next legal move to be filing a petition with either the DC circuit or the Supreme Court and requesting a stay based on irreparable harm that, it will argue, will occur if it is forced to sell or have TikTok banned before the case can be heard on appeal," he said
