Heather assists clients in a variety of matters, including:

  • Representation of large public and small private companies nationwide, including companies in the oil, natural gas, energy, securities, insurance and telecommunications business.
    • Obtained summary judgment in favor of large energy company in $20 million complex breach of contract case in federal court involving numerous agreements relating to the acquisition, development and operation of oil and gas properties.
    • Obtained summary judgment in favor of large energy company in defense of multi-million dollar tortious interference claim involving the acquisition of oil and gas properties.
    • Successful appeal of trial court’s denial of motion to reconsider order granting summary judgment on basis that court’s decision constituted impermissible collateral attack of pooling order, Indio Investments, Inc. et. al. v. Mesa Ridge Resources, Inc., et al., In the Court of Civil Appeals of the State of Oklahoma, Division IV, Case No. 108,928.
    • Successful appeal of trial court’s dismissal of action under the Oklahoma Production Revenue Standards Act, Gaskins v. Texon, 321 P.3d 985 (Okla. Ct. Civ. App. 2014), cert. denied. 
    • Successfully defended client in arbitration against claims of tortious interference with contract/business expectancy relating to the construction of a natural gas distribution system.
    • Successfully defended former employees of national construction equipment rental company in lawsuits for injunctive relief and damages for alleged violations of non-compete agreements.
    • Obtained favorable resolution for company in multi-million dollar arbitration claims arising out of a contract to design and construct a plant for treatment and processing of CO2 and related litigation involving a multi-million dollar contract to provide compression and refrigeration equipment for the CO2 processing plant.
    • Ongoing representation of companies in litigation matters involving the acquisition, development and production of oil and gas properties and royalty owner disputes.
  • Provide legal counsel to executive/senior management of clients regarding contract/commercial disputes, discovery obligations, litigation management and budgeting and conflict resolution strategies.
  • Advise companies regarding corporate compliance and governance issues regarding document retention requirements, securities laws, antitrust laws, and other federal and state statutes and regulations.
  • Multi-state practice on complex commercial litigation and energy law teams involving litigation of contract, construction, oil and gas, business torts, intellectual property, unfair competition, trade secret and antitrust matters.
